Through my life, as a daughter of a renowned justice reformer, a granddaughter to a supreme court judge, a law student I wholeheartedly believe that a lawyer is a social engineer. That the purpose of law is to facilitate a better change for a society.
Through my career life, I saw firsthand how being a lawyer could affect change on an individual, organizational, and social structural level. However, I was unsure where I could contribute to improve society in the role that fits with my life value. I was trained as a business lawyer, earning my bachelor degree from Chulalongkorn University before becoming a project financing lawyer at Baker Mckenzie, Thailand. From a compliance perspective, I witnessed how the law could set the standard of practices for business, which then affected the life of individuals in the society. However, yearning for a more proactive role, I went off to explore the alternative paths of what a lawyer could do as a social engineer. With 2 master of law degrees from Cambridge and Stanford University, I fell in love with the intersection of justice, human-centered design, and collective impact approach. The intersection of these sciences was indeed out of the usual role of a lawyer or a traditional policy maker.
Discovering the bold vision of the Thailand Institute of Justice to solve the persisting justice problems, I landed my job here upon coming back to Thailand in mid 2018. My only task then was to set up the new unit – the unit that is now known as the TIJ Justice Innovation.
It took 3 years to test run and prototype until the time was ripe. The journey to set up the unit has been a steep learning curve for me. Not only about the complicated and entangled justice issues, but also about figuring out the purpose and value of myself in this ever-changing world. When the unit was officially up and running in early 2021, I felt, for the first time, like I too had found my true self, even not completely, but more tangible than before.
Upon establishing the unit, we flagged our long term goal at building a ‘people-centered justice system’ through innovation and collaborative process.This goal resonates with my life value. I believe in human potential and the power of empowerment and collaboration. The unit allows me to thrive in the intersection of law, human-centered design, and collective impact approach.
Although it is still challenging work (until now, I still struggle to find a short way to explain what I do), it is a rewarding one. To me, it is a place where an outliner lawyer like me feels belong. To me, it is a place where the belief ‘lawyer as a social engineer’ could be truly realized.
เราเกิดในครอบครัวนักกฎหมาย พ่อเป็นนักปฏิรูปกฎหมายที่คนนับถือ คุณตาเป็นศาลฎีกา ตัวเองก็เลือกเรียนกฎหมาย และทำงานอยู่ในวงการนี้มาตลอด ทุก ๆ เหตุการณ์ในชีวิต ที่ให้เราเชื่อสุดหัวใจว่า นักกฎหมายที่ดีคือนักกฎหมายที่เป็นวิศวกรสังคม ว่าจุดประสงค์สูงสุดของกฎหมายคือการเป็นเครื่องมือในการพัฒนาสังคม
ตลอดระยะเวลาที่ทำงานอยู่ในวงการกฎหมาย เราได้เห็นว่ากฎหมายสามารถเปลี่ยนวิถีชีวิตของคนคนหนึ่ง เปลี่ยนกระบวนการตัดสินใจขององค์กร ไปจนถึงเปลี่ยนโครงสร้างการทำงานของสังคม แต่เมื่อมองดูทางเลือกอาชีพต่าง ๆ ในวงการกฎหมายเท่าที่เรารู้จัก เราไม่เห็นบทบาทของนักกฎหมายในแบบที่เราอยากจะเป็น
เราเรียนจบปริญญาตรีกฎหมายธุรกิจจากนิติศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย และเข้าทำงานเป็นที่ปรึกษากฎหมายด้าน Project Finance ที่บริษัท Baker McKenzie เราได้เห็นบทบาทของที่ปรึกษากฎหมายว่า สามารถจะโน้มน้าวให้บริษํทต้องปฎิบัติตามหลักเกณฑ์บางอย่าง เพื่อปกป้องผู้เกี่ยวข้องที่อาจจะมีอำนาจต่อรองน้อยกว่า แต่บทบาทนี้ไม่ใช้บทบาทเชิงรุกมากพอสำหรับเรา เราจึงตัดสินใจไปเรียนต่อ เพื่อตามหาทางเลือกใหม่ ๆ ว่านักกฎหมายสายพัฒนาสังคมสามารถทำอะไรได้บ้าง
เราได้ทุนไปเรียนที่มหาวิยาลัยเคมบริดจ์ที่ประเทศอังกฤษ และ สแตนฟอร์ดที่ประเทศอเมริกา ประสบการณ์การไปเรียนต่อ ทำให้เราพบความชอบของตัวเอง ว่าอยู่ในเรื่องที่เกี่ยวกับ ความยุติธรรม เรื่องราว ความรู้สึกประสบการณ์ของคน และ การสร้างความเปลี่ยนแปลงด้วยการมีส่วนร่วม นอกจากนี้ เราก็ยังพบว่า สายอาชีพของนักกฎหมายที่ตกหลุมรักสิ่งเหล่านี้ ไม่มีอยู่เลยในตลาดงานของนักกฎหมายหรือนักนโยบายสาย classic
ตอนเรียนจบ เราได้ยินถึงวิสัยทัศของ TIJ ที่ต้องการสร้างความเปลี่ยนแปลงด้านความยุติธรรมด้วยวิธีใหม่ ๆ เราจึงตัดสินใจเข้ามาร่วมงานด้วยในปี 2018 เป็นการเปลี่ยนแปลงสายงานครั้งใหญ่เพราะ เปลี่ยนจากสายธุรกิจ มาเป็นสายอาชญากรรม หน้าที่ของเรามีอยู่อย่างเดียว คือ ตั้งสำนักนวัตกรรมเพื่อความยุติธรรม
เราใช้เวลาประมาณ 3 ปีในการเรียนรู้ ทดลองเครื่องมือ สร้างเครือข่าย และสร้างผลงาน จนเห็นความต้องการของตลาดจากจำนวนงานที่เพิ่มขึ้นจนล้นมือ 3 ปีในการสร้างสำนักนวัตกรรมถือเป็นการเปิดโลกการเรียนรู้ของเรา เพราะทุกอย่างเราต้องคิดขึ้นใหม่ ไม่มีใครเคยทำมาก่อน ไม่มีตัวอย่าง ไม่รู้ว่าที่ดีที่สุดต้องหน้าตาแบบไหน เรากลัวความผิดพลาดที่อาจทำให้เราไม่ได้ไปต่อ แต่ประสบการณ์จากการสร้างโครงการต้นแบบนวัตกรรมมากมาย สอนให้เรารู้ว่า ความสำเร็จ ไม่ได้จะต้องอยู่เฉพาะที่ตอนจบ ที่เราสามารถแก้ปัญหาได้ ปัญหาเรื่องความยุติธรรมใหญ่และซับซ้อน แต่ความสำเร็จสามารถวัดจากจำนวนเครื่อข่ายและเพื่อนร่วมอุดมการณ์ที่เพิ่มขึ้นอยู่ตลอดเวลา วัดจากความรู้ของเราที่สามารถระบุข้อท้าทายของปัญหาเชิงโครงสร้างที่ซับซ้อนได้ตรงจุดมากขึ้นเรื่อย ๆ และที่สำคัญ วัดจากการที่ภาพระบบนิเวศของนวัตกรรมเพื่อความยุติธรรมในประเทศไทยค่อย ๆ เริ่มชัดขึ้น ความสำเร็จเล็ก ๆ ที่บอกเราว่า แม้จะมีคำถามมากมายที่เรายังตอบไม่ได้ แต่เรากำลังเดินไปข้างหน้าอยู่ทุกวัน
มันไม่ใช่แค่การเรียนรู้เกี่ยวกับปัญหาด้านความยุติธรรมในสังคมไทย หรือ ทักษะในการทำงาน แต่มันคือการเรียนรู้เกี่ยวกับคุณค่า และ ความเชื่อของตัวเองด้วย ในวันที่เราตั้งสำนักนวัตกรรม แม้ว่าจะยังมีหลาย ๆ อย่างที่คลุมเคลือ แต่สิ่งหนึ่งที่ชัดเจนขึ้นสำหรับเราคือ เรารู้ว่า งานที่นี่ บทบาทแบบนี้แหละ ที่นักกฎหมายสายพัฒนาจะสามารถทำหน้าที่ได้เต็มที่
